These Terms and Conditions (from now on referred to as "Conditions") apply to all users or customers of the website (from now on referred to as User(s)) and to any commercial transactions carried out through its online store.

INTRODUCTION

By using this website and/or purchasing any product from the online store, the User agrees to these Conditions and other policies governing the use of the website (namely, Privacy and Cookie Policies). FeliPé Shoes Lda requests that you carefully read these Conditions and the associated policies before using this website.

The contractual offer related to the purchase and sale of products sold in this Online Store is directed only to individuals who are of legal age, with full capacity, and who can therefore take responsibility for the commitments arising from the purchase and sale of the products marketed.

If the User does not agree, in whole or in part, with these Conditions, they should not access the website or any associated features and services, including the Online Store. Specifically, completing any purchase through the Online Store is contingent upon acceptance of these Conditions, so if they do not agree, they will not be able to use it.

The User's acceptance of these Conditions is made on their personal behalf. By placing orders through the Online Store, the User declares they are over 18 years old, confirming they have full legal capacity and the necessary authority to make such acceptance. Furthermore, by accepting these Conditions, the User explicitly declares that they will not use the website and the associated features or services for illegal and/or unlawful purposes.

The User will be responsible for periodically checking for any changes, with the website's use governed by the conditions in effect at the time of access.

Access and continued use of this website after the publication of any updates, modifications, or replacements of the Conditions and associated policies, except for the Privacy Policy, constitutes acceptance and agreement to those updates, modifications, or replacements.

Notwithstanding any changes to these Conditions, the Terms and Conditions in effect at the time of order confirmation will apply to each order.

FeliPé Shoes Lda guarantees the security of the User's account within the expected and appropriate security measures for platforms such as this website and its online store.

By using this website, the User acknowledges that their personal data will be processed by FeliPé Shoes Lda, as identified above, and declares that all information or data provided is truthful and accurate. FeliPé Shoes Lda will not be held liable for any inaccuracies in the information provided by Users on the website, as Users are entirely responsible for its accuracy, completeness, and updating.

USE OF THE WEBSITE

Service Availability

FeliPé Shoes Lda is not responsible for any damages arising from interferences, interruptions, computer viruses, system malfunctions, or disconnections that may temporarily prevent access, navigation, or provision of services to Users.

Under no circumstances will FeliPé Shoes Lda (and/or its representatives or employees) be held liable for any damages resulting from the malfunction of this website, regardless of the duration of such malfunction, or for any damages caused by the reproduction, use, or exploitation of the website that violates these Conditions.

FeliPé Shoes Lda reserves the right to modify, at any time, the information and commercial offer presented on products, prices, promotions, commercial terms, and services.

FeliPé Shoes Lda has the exclusive right to unilaterally suspend or terminate, partially or fully, temporarily or permanently, access to the website, particularly during operations of management, maintenance, repair, modification, or modernisation, without prior notice.

A violation of these Conditions by the User constitutes grounds for their termination by FeliPé Shoes Lda, which reserves the right to terminate the User's access to the website and its functionalities and services at any time, with or without prior notice. In any case, the violation of these Conditions by the User, whether or not the access is terminated, grants FeliPé Shoes Lda the right to be compensated for all damages resulting from such violation.

Customer Registration on the Website

Merely accessing the website does not require registration. However, to enjoy all its features and services, particularly to place an order, User registration will be necessary.

To register, the User must create an account by completing the form and providing, as mandatory, an email address and password. Additionally, the following personal data will also be requested:

4. Date of birth (optional)

After registration, for subsequent logins, the User will only need to identify themselves using the email address and password provided during account creation.

The User is responsible for the accuracy, completeness, and legality of the data provided during registration. As such, the User will be solely responsible for any false or inaccurate statements they make, as well as for all activities that occur in their account. FeliPé Shoes Lda is not required to monitor the content or compliance with responsibilities of the User, particularly with regard to other Users or national authorities.

FeliPé Shoes Lda does not have access to or knowledge of the password set by the User. It is the User's responsibility to ensure the confidentiality of the password and to safeguard and properly use it, as well as to follow best practices related to account security (especially by changing the password regularly and avoiding connections through public networks). FeliPé Shoes Lda cannot be held responsible for damages arising from the loss or misuse of the User's password.

Placing an Order

All products available on the FeliPé Shoes Lda website are illustrated with photographs and have their essential features listed.

FeliPé Shoes Lda makes every effort to ensure that the information presented is up to date and free from typographical errors. However, should errors occur, they will be corrected as soon as possible.

At any time, FeliPé Shoes Lda may alter, remove, or move any information/product on the website and Online Store without prior notice, including prices, promotions, offers, commercial conditions, and services.

The User expressly agrees to the following:

1. The images are purely illustrative and may not exactly match the real appearance of the products. Therefore, the User should carefully and thoroughly read the information provided on the website regarding the essential characteristics of each product, warnings, and usage instructions. If in doubt, the User can contact FeliPé Shoes Lda for additional information by filling out the information request form
2. All products for sale on the website are subject to stock availability, although FeliPé Shoes Lda strives to provide updated information regarding product availability. FeliPé Shoes Lda is not obligated to supply products that are unavailable. If any ordered products are unavailable, FeliPé Shoes Lda will immediately inform the User and refund the corresponding price within 30 days
3. FeliPé Shoes Lda will not assume responsibility for any discontinued items. In such cases, the applicable procedure for unavailable products, as described in the previous item, will apply
4. The prices and products displayed on the website are valid only for transactions made through the Online Store.

To place an order, the User must follow the online shopping procedure, including adding the desired products to the shopping cart, indicating the number of units, and, when applicable, the corresponding size and color.

Once the product selection is complete, the User must select the "Finalize Order" option and proceed according to the instructions, either logging in or creating a new registration and follow the prompted steps and subsequent sections.

Prices

The price of products will be as stipulated on our website, except in the case of an obvious error. While we make every effort to ensure that the prices displayed on the website are correct, errors may still occur. In the case of an obvious pricing error, FeliPé Shoes Lda will immediately inform the User and offer them the option to confirm the order at the correct price or cancel it. If the User cannot be contacted, the order will be considered canceled, and any amounts paid will be fully refunded.

Online prices may differ from those in physical stores as they are separate channels. The customer can choose the purchasing channel, respecting the applied price.

The prices displayed include VAT at the current legal rate in Portugal. These prices will be supplemented by applicable shipping costs, depending on the destination.

Prices are subject to change at any time, but any changes will not affect orders for which an "Order Confirmation" has already been sent.

Delivery Methods and Payment Options

To finalize the order, the User must select the desired delivery and payment methods, choosing from the following options available on the website:

Online purchase with delivery to the address indicated by the User:

In this case, the User must specify the desired delivery method and provide delivery details (name and address), so FeliPé Shoes Lda can forward them to the delivery carrier.

Products sold through the Online Store are available for delivery throughout the European Union, subject to stock availability. Unless in extraordinary circumstances, orders will be delivered according to the established delivery times for the final destination.

The User may choose from the following delivery methods available on the "Shipping and Delivery" page.

Despite the indicated delivery times, delays may occur for any of the following reasons:

1. Delays by the carriers
2. Delivery difficulties for the recipient
3. Local holidays

Delivery times refer to working days, with no order processing or shipping on Saturdays, Sundays, or national holidays.

Payment must be made through one of the available payment methods, with the User choosing to pay via a valid multibanco reference for 72 hours, Visa or MasterCard, or another payment method available at the time on the website.

The order processing and dispatch will only begin after the payment is confirmed.

Billing Information

When opting to purchase products online, the User will need to provide the following billing details:

1. Full name
2. Phone contact
3. Billing address
4. VAT number to appear on the invoice

The registration details mentioned above will be requested from the User during the first purchase on the website and will be stored for future purchases. However, the User may choose to enter new information for subsequent purchases.

Order Completion

Before confirming the order, a summary of the order will be presented, including a list of selected products, their prices, VAT amounts, delivery method, payment method, and billing information, if applicable.

The User agrees to verify the data in their order summary and should go back to the previous steps to correct any discrepancies if identified.

To complete the order, the User must carefully read these Conditions and indicate their agreement by checking the appropriate box. Accepting these Conditions is a prerequisite for continuing the operation. The User should immediately print and save the Terms and Conditions for future reference.

Once the order is completed, the User will receive an automatic email with the "Order Confirmation." If the details are incorrect, they may immediately request the cancellation of the purchase/reservation.

For online purchases, by completing the described procedure and finalising the order, the User is entering into a purchase and sale contract with FeliPé Shoes Lda.

Once the total price of the products is paid, the invoice will be issued and sent to the email provided by the User. After issuance, the invoice cannot be reissued with changes.

Failure to Deliver

If the order cannot be delivered due to the absence of the recipient at the specified location or an incorrect address, […the order will be available for pickup at our stores || will be available for pickup at the carrier’s terminal || will be returned || …].

OR

[We will contact the User || The carrier will contact the User] to arrange a new delivery, with additional shipping charges for redelivery.

EXCHANGE AND RETURN POLICY

Right of Free Contract Resolution

Under Decree-Law No. 24/2014, of February 14, as amended by Law No. 47/2012, of July 28, and by Decree-Law No. 78/2018, of October 15, Consumers, as defined in the mentioned legal framework, have the right to freely resolve the contract up to 30 days after receiving the order, without any need for justification.

To exercise the right to freely resolve the contract, the User has the following options:

1. If the "Order Shipping Confirmation" email has not yet been received, the User must clearly express their intention to cancel the order through the contact form or by phone.
2. If the "Order Shipping Confirmation" email has already been received, the User must wait for the delivery of the order, then fill out the return form and return the order.

Once the right to freely resolve the contract is exercised in accordance with the above, FeliPé Shoes Lda will acknowledge receipt of this declaration within 24 hours via email sent to the User.

The right of free resolution may be exercised by the User for all the products purchased or only for some of the products included in the order.

Effects of Free Contract Resolution

Whenever the right of free resolution is validly exercised by the User, they will be fully refunded the price paid for the products and the respective delivery costs within 14 days from the date of the resolution decision.

If the products have already been received, the User must return them to FeliPé Shoes Lda's premises within 14 days from the date of communication of their decision to resolve the contract, bearing any costs related to their return. No products sent to us via cash on delivery will be accepted.

After receiving the returned products, we will verify them to ensure they are complete and in the same condition in which they were shipped. Once this verification is complete, and no issues are detected, we will proceed with the refund of the amount paid via the same payment method used by the User for the original transaction.

FeliPé Shoes Lda reserves the right to withhold the refund until the products are received or until the consumer provides proof of their return, as well as the right to refuse the refund of a product that has been returned but is not in the same condition as when it was shipped.

Exceptions

The provisions of these Conditions do not apply in cases where the products sold are sealed and not returnable for reasons of health or hygiene protection once opened after delivery. In these situations, the right to freely resolve the contract does not apply.

Contractual Right to Return Products

After receiving the products, the User may return and/or exchange them under the terms outlined below. This right can be exercised for all the products purchased or only for some of the products included in an order.

The User has 30 days, from the date of delivery of the respective order, to return the products purchased online.

The User may also choose to exchange the products purchased online at the FeliPé Shoes Lda physical store, within 15 days for this purpose, subject to the store's rules.

The contractual right to return the products applies exclusively to products that can be returned in the same condition in which the User received them. Returns/exchanges will not be accepted for products that have been used, or whose labels have been removed and/or cut, or that show damage caused by the User.

Any alteration to the products beyond the simple opening of their packaging invalidates the possibility of return or exchange.

The products must be returned with or including, cumulatively:

1. The original packaging
2. The order confirmation number and/or a copy of the invoice/receipt
3. All labels and packaging of the products

Upon receiving the returned order, FeliPé Shoes Lda will verify the condition of the products, checking if they are in the exact same condition as when they were shipped, namely with all labels and constituent parts/accessories, unused, and without any damage caused by the User.

After validating the condition of the products, FeliPé Shoes Lda will review the original order and the return form, approving or rejecting the return. If the return is accepted, the amount paid will be refunded via the same payment method used by the User for the original transaction.

If the return was made within the period stipulated in these Terms and the product meets all the necessary requirements identified, the return will be processed.

If the conditions described above are not met, the return will be rejected and the User will be notified by email, with an explanation of the rejection reasons. The User may request the reshipment of the products that were not accepted for return, bearing the return shipping costs.

Exceptions

The provisions of these Terms do not apply in cases where the products sold are sealed and non-returnable for health or hygiene protection reasons, once opened after delivery. In such cases, FeliPé Shoes Lda reserves the right to refuse the return of products opened after delivery.

PRODUCT WARRANTY

Defective Products

FeliPé Shoes Lda ensures that all products are subject to a quality inspection. However, FeliPé Shoes Lda is liable for any lack of conformity of products sold to Consumers that manifests within 2 years from the date of delivery, provided it is communicated to FeliPé Shoes Lda within a maximum of 2 months from the date the defect was detected.

Products are considered non-conforming with the purchase agreement if any of the following occur:

1. When the products do not conform to the description provided by FeliPé Shoes Lda on its website
2. When the products are not suitable for the specific use for which they are intended
3. When the products are not suitable for the typical uses of goods of the same type
4. When the products do not exhibit the usual qualities and performance expected from goods of the same type, which the User can reasonably expect based on the nature of the goods, and any public statements made by FeliPé Shoes Lda regarding their specific characteristics

During the warranty period, if a product presents a manufacturing defect, it will be replaced with a similar model, if repair is not possible.

If the User believes the product purchased contains a defect, they should contact FeliPé Shoes via the contact form, providing the order number, the corresponding invoice, describing the defect, and, if possible, attaching photographs of the defective item.

FeliPé Shoes Lda will analyse and confirm whether a non-conformity exists, and if confirmed, will replace the product at no cost to the User. FeliPé Shoes Lda will contact the User to arrange the collection of the non-conforming product, covering all return and reshipping costs.

Exclusions from Warranty

There will be no lack of conformity or defect in products if, at the time the contract was made, the User was aware of such non-conformity or defect, or could reasonably have ignored it. Therefore, if the product was sold with explicit mention of the defect, it cannot be returned as defective. However, the User still has access to the return procedures outlined in these Terms.

The warranty excludes materials that are subject to breakage, deterioration, oxidation, loss, or theft, defects caused by impact, improper use, improper maintenance and cleaning, negligence, misuse, unauthorised repairs, accidents, normal wear and tear, and damages caused by the use of other products, either in combination with them or separately.

LIABILITY

To the fullest extent permitted by law, FeliPé Shoes Lda will only be responsible for damages resulting from gross negligence or intentional misconduct. FeliPé Shoes Lda does not assume any responsibility for the continuous availability of its website, particularly in relation to mobile networks, the internet, and mobile devices.

USER SUPPORT

The User may request assistance, submit comments, suggestions, or complaints to FeliPé Shoes Lda via the dedicated form available on the website. FeliPé Shoes Lda is available to clarify any doubts or resolve any issues related to the products supplied.

ALTERNATIVE DISPUTE RESOLUTION

In case of a dispute regarding contractual obligations arising from sales contracts, in accordance with EU Regulation No. 524/2013, the User may seek to resolve the dispute out of court via the online dispute resolution platform at:

http://ec.europa.eu/consumers/odr/.

FeliPé Shoes Lda is not bound to any alternative dispute resolution entity by mandatory arbitration.

INTELLECTUAL PROPERTY

The User acknowledges and agrees that all intellectual property rights, including but not limited to copyright, registered trademarks, designs, trade secrets, or any other materials or content provided as part of the website, are at all times the property of FeliPé Shoes Lda or its licensors. The User may only use this material in the manner expressly authorised by us or by the entity that has granted us the license to use it.

These Terms do not grant the User any rights to use trademarks, logos, designs, or any other intellectual property rights owned or licensed to FeliPé Shoes Lda.

The User may not copy, translate, disassemble, decompile, or create, or attempt to create, through reverse engineering or otherwise, the source code and/or object code of the website, nor remove any confidentiality or intellectual property notices contained on the Website.

FeliPé Shoes Lda ensures that, to the best of its knowledge, it does not infringe any third-party intellectual property rights.

VIRUSES, PIRACY, AND OTHER CYBER ATTACKS

The User should not misuse this website by intentionally introducing viruses, Trojans, spyware, malware, or any other harmful or technologically damaging materials. The User must not attempt to gain unauthorised access to this website, the server hosting this page, or any related server, computer, or database. The User agrees not to attack the website in any way, including via a denial of service attack or a distributed denial of service attack.

Failure to comply with this clause may result in the commission of various crimes under data protection and cybercrime legislation, which will be reported to the relevant authorities.

If our website contains links to third-party pages and materials, these links are provided for informational purposes only, and we have no control or responsibility over the content of those pages or materials, or their policies and practices. EVENTS BEYOND OUR CONTROL 

FeliPé Shoes Lda will not be held responsible for any failure or delay in fulfilling any obligations that result from events beyond our control.

The concept of Events beyond our control include any act, event, failure to act, omission, or accident that is beyond our control, including but not limited to:

1. General strike or other forms of protest significantly affecting the country
2. Public disturbances, revolt, invasion, terrorist attack or threat, war (declared or not) or threat/preparation for war
3. Fire, explosion, storm, floods, earthquake, collapse, epidemic, or any other natural disaster
4. Inability to use public or private telecommunications systems
5. Inability to use railway, maritime, air, road, or other public or private means of transportation
6. Laws, decrees, regulations, or government restrictions.

Any obligations will be suspended during the period in which Events beyond our control occur, and deadlines will be extended for the duration of such events.

FINAL PROVISIONS

The sales conditions presented are governed by Portuguese law, without prejudice to other rights recognised to the consumer under applicable legislation.

FeliPé Shoes Lda has the right to amend these Terms at any time. The User will be subject to the principles and terms in effect at the time of their order, unless the law or a competent authority imposes any changes to them (and such changes will apply to orders already placed).

These Terms, including the Privacy and Cookie Policies, constitute the entire agreement between the User and FeliPé Shoes Lda regarding the use of the website.

The Policies are an integral part of these Terms and cannot be separated from them.

THE USER DECLARES THAT THEY HAVE READ AND UNDERSTOOD THESE GENERAL TERMS, AS WELL AS THE POLICIES ASSOCIATED WITH THEM, AND THAT THEY HAD THE OPPORTUNITY TO SEEK INDEPENDENT LEGAL ADVICE BEFORE ACCEPTING THEM. THEY ALSO ACKNOWLEDGE THAT THIS IS THE COMPLETE AND EXCLUSIVE STATEMENT OF THE AGREEMENT BETWEEN THEM AND FELIPÉ SHOES LDA, WHICH REPLACES ANY PREVIOUS PROPOSAL OR AGREEMENT, WRITTEN OR ORAL, AND ANY OTHER COMMUNICATION BETWEEN THEM AND FELIPÉ SHOES LDA, REGARDING THE SUBJECT OF THIS CONTRACT.
